Speeding May Be Primary Reason for Fatal Truck Accident
Posted By Personal Injury Editor

Police have yet to release the identity of a truck driver killed in the state of Nevada last week. According to the police report, the vehicle was reportedly attempting to take an exit ramp at excessive speeds, which caused it to crash nearby.  Thanks to the fast work of emergency road crews, a fire started by the accident was quickly extinguished. However, it was not fast enough to save the driver. It took nearly an hour to remove the driver's body from the mangled wreckage. Firefighters were on hand in case the fire spread to nearby wooded areas.

Luckily, nobody else was injured in the accident. At this time, police have yet to determine the cause of the accident, although speed is being blamed preliminarily. The ramp where the truck driver lost his life was the spot of another fatal truck accident in 2010. At that time, the semi-truck went off the ramp and hit a tree, killing the driver.  If you were injured during a truck accident, don't wait to enlist the help and guidance of a personal injury attorney near you!

The 45-year-old victim was working as a flagger when a fellow co-worker ran her over. The woman was loading up a nearby truck when a coworker struck her from behind. At this time, the identity of the 36-year-odl man that caused the injuries is being kept from the public.   Trucker Facing Murder Charges for Collision
Posted By Personal Injury Editor

After ignoring warnings about the dangerous nature of a mountain road, a semi-truck driver could now face a murder conviction.

The fatal truck accident, which took place earlier this year, claimed the life of two people and injured three more. The driver, a 46-year-old veteran of the road, didn't heed the warnings of an off-duty fireman who knew about the dangerous nature of San Gabriel Mountains for 18-wheelers. Although the driver did stop once to cool down the brakes, he got onto the roadway shortly after. Inevitably, the load of his truck was too much for the steep roadway and his brakes burned out.

As a result, the driver lost control of his vehicle and smashed into a building at the bottom of the hill. He has since been charged with seven felony counts, including reckless driving, gross vehicular manslaughter and second-degree murder. Although his lawyer is arguing that the truck accident was unintentional and should not be deemed to be murder, it is uncertain what the judge and jury will think about the crime.

If you have suffered after being involved in a truck accident, it is important that you review your legal options and rights with a personal injury attorney as you may be allowed to file a lawsuit to collect compensation.

What to Do After an Accident
Posted By Personal Injury Editor

If you’ve recently been injured in an accident you’re likely feeling a little shaken up and unsure of what to do next.  After an accident, it’s very important that you take the following steps, as they can affect the success of your claim, should you choose to pursue one.

  1. Seek medical treatment right away. A doctor can determine the extent your injuries and treat them accordingly. Furthermore, if you plan on filing a lawsuit, you will need to know the extent of your injuries and the toll they will take on your life so you know how much in damages you should seek. The insurance company and the judge will also take your injuries more seriously if they’ve seen that you went to the doctor for help.
  2. Make sure you are completely honest with your doctor. Do not try to downplay your symptoms. Your doctor needs all the information you can provide so he or she can make a correct diagnosis.
  3. After you’ve seen a doctor, then hire an attorney. It is important that you speak with an attorney as soon as possible. The attorney might need to go to the scene of the accident, speak with witnesses, consult accident experts, and collect crucial evidence. The sooner you contact an attorney, the sooner action can be taken to start building a case.
  4. Make sure you document anytime you’ve missed work due to your injuries, as you have the right to recover compensation for lost wages.
  5. Contact your insurance company and tell them you were in an accident, but make sure you don’t imply that you were responsible for the accident. An attorney can help you file a claim with the insurance company and determine if you have any additional benefits.
  6. Do not speak to the other party’s insurance company. Often times they try to trick you into making statements that will damage your case. Insurance adjusters have clever ways of phrasing questions to try and get people to admit they were at least somehow responsible for the accident. If the other party’s insurance company tries to contact you, you can ask your attorney to speak to them on your behalf.
  7. In general, it’s a good idea not to talk to anyone about the accident other than your doctor and your attorney.

For more tips on what steps you should take following an accident, please do not hesitate to consult an experienced personal injury attorney near you. You’ll be glad you did.

Husband Files Wrongful Death Suit Against Truck Driver
Posted By Personal Injury Editor

A wrongful death lawsuit involving a fatal truck accident has been filed in Daviess County, Missouri.

The lawsuit was filed by Joseph Hostetler against David Leeper and Kenneth Fletcher. Hostetler’s wife Maria was killed in the accident after her van crashed into the back of the truck.

The accident occurred on November 10, 2009 on Highway 6. According to the Missouri State Highway Patrol, a Chevrolet grain truck lost the left rear tandem as it was slowing to turn onto Route V. Leeper was driving the truck and was able to steer his vehicle onto the shoulder of the road. However, during the time the left rear tandem was still on the road, Hostetler hit one of the truck’s tire/wheel combinations with her van. This caused the van to swerve onto the opposite side of the road, skid in a clockwise motion, and travel back into her original lane. But as the van approached the edge of the road it tipped over onto its side and crashed into the back of the truck. Hostetler and two of her passengers, Chester Gingerich and Perry Gingerich, were killed in the accident. Three other passengers in Hostetler’s vehicle were injured.

The case has been assigned to a judge but a hearing has not yet been scheduled.

If you have lost a loved one in a fatal truck accident and are considering filing a  wrongful death lawsuit, you should consult an experienced Missouri truck accident lawyer about your rights to compensation. If you can prove another party was at fault for the accident, you could be awarded wrongful death benefits and punitive damages.

Truck Driver Causes Fatal Accident While Watching Porn
Posted By Personal Injury Editor

Charges have been filed against a truck driver who caused a fatal accident as he watched pornographic movies on his laptop.

The accident occurred when truck driver Thomas Wallace crashed into a woman’s car on the New York State Thruway near Buffalo. Julie Stratton, a 33-year-old mother of two, was killed in the accident. After hitting a deer, she had pulled off to the side of the road to wait for help.

Wallace has since been charged with second-degree manslaughter after police determined he was distracted by the pornographic movies at the time of the accident.

Police also say Wallace had slept less than four hours over a 27-hour period. Under federal law, truck drivers can only drive for a maximum of 11 continuous hours in a 14 hour work day, after which they must take a mandatory rest period of 10 hours before than can drive again.

At this time, it has not been said whether or not Stratton’s family will file a personal injury lawsuit.

In Medford, Oregon, a man recently filed a personal injury lawsuit against a logging company and also the U.S. Forest Service. According to the man, Bert Fernandez, both defendants failed to cut down a tree that fell, causing him serious injuries.

Fernandez filed his lawsuit on Monday in the U.S. District Court. In his civil action, he says that he was driving on February 8, 2008 through the Rogue National Forest. While driving, a 32 foot tree fell on top of his truck, which caused him to sustain major injuries.

The claim states that the tree was supposed to be cut down by the logging company because it had been marked by the U.S. Forest Service for removal. However, due to the fact that the tree was not removed by the logging company, Fernandez was involved in a truck accident.

Fernandez is currently seeking $900,000 in damages for his medical bills, lost wages and pain and suffering.  The lawsuit paperwork lists Dodenhoff Logging Co. and the U.S. Government as defendants.

Being involved in a truck accident is always devastating. However, matters become more complicated when you think the Government or State is at fault.
