  Grocery Store Being Sued for Slip and Fall

A grocery store in Clear Lake is being sued by a former customer that claims to have slipped and fallen while shopping. The man claims to have been walking through the store on May 3, 2010 when he fell on water from a leaking refrigerator.

While slip and fall cases are fairly common to larger chain stores, a lawsuit like this could be seriously damaging to a smaller grocery store. The Texas store could be asked to pay millions of dollars in damages for past, existing and future pain and suffering. The victim is asking the grocery store to pay court costs and damages. It is uncertain how much he is asking for at this time.

  Woman Suing for Slip on Liquids in Grocery Store

After falling in a liquid substance in a grocery store, a woman is now suing the store for her subsequent injuries.

According to Marsha Raglin, the victim, she was grocery shopping at Supervalu and Shop N'Save when she slipped and fell in a puddle of something wet. As a result, she suffered permanent injuries to her right shoulder, which has since required two surgeries. She still suffers from constant, nagging pain, as well as the mental anguish of having to deal with her injuries. She is now suing for endured disability, inability to perform usual duties, lost wages, loss of normal life, sustained disfigurement and medical costs.

Raglin names the store's manager, Linda Dublo, as the primary person responsible for her accident. By failing to routinely inspect the Supervalu store and provide a safe environment for customers, Dublo is to be held accountable for Raglin's injuries. The lawsuit lists three counts against Dublo and Supervalu, asking for a total of $150,000 plus court and legal fees.

  Wal-mart Hit With Another Slip and Fall Case

Wal-mart is hit with yet another slip and fall lawsuit, this time for a man who injured himself in the pet food aisle.

According to the slip and fall lawsuit that was filed against the chain store, Jeffrey Anderson was shopping at the location in La Place on June 9, 2010 when he slipped and fell on something wet. As a result of his slip and fall accident, he injured his back, arm and sides. Anderson, along with wife Leola, contends that Wal-mart failed to provide a non-hazardous and safe environment in which to shop. In addition, the store failed to provide warning about the hazardous area nor did they provide an area that was conducive to safe shopping.

They are now suing Wal-mart for mental pain and suffering, physical pain and suffering, loss of consortium, medical expenses, emotional distress, along with interest and court costs.

  Slip and Fall Lawsuit Filed Against Car Dealership

Larry Ellison found himself in an unique position this month, as foreman of a jury in San Mateo County.

The jury later decided in favor of the plaintiff who had filed a slip and fall lawsuit against a local Ford dealership. Elisa Miramontes, as well as her husband, were awarded a total of $472,000 by the jury; $300,000 was for medical damages, while the rest was intended for suffering and pain and economic loss. Miramontes injured herself at the dealership when she slipped in a pool of diesel fuel.

  Woman Sues Webster Restaurant for Slip and Fall

After a slip and fall accident left her seriously injured, Melanie Britt is suing a restaurant in Webster for her suffering.

The lawsuit was filed on Feb. 15 against Cheddar's Casual Cafe in the Harris County District Court. Britt alleged negligence on the part of Cheddar's for failing to mop down or provide a sign warning about the slippery floor. She believes that the substance that made the floor slippery was a chemical cleaner left there by an employee.

Britt is asking for court costs and actual damages. She has hired an attorney from Houston, Michael Watson, to represent her.

  Starbucks Settles Slip and Fall Lawsuit

A slip and fall case against Starbucks Corporation has settled for $4.8 million in Los Angeles.  Mildred and Edwin Rodgers have been engaged in the suit against the corporate coffee giant since September 15, 2010.

In November of 2005, Mildred Rodgers was entering a Pasadena Starbucks through its rear entrance when she tripped on a raised portion of the flooring.  The fall caused Mrs. Rodgers to fracture her leg and require surgery.  Soon after the surgery, she suffered a stroke.

Starbucks has denied any knowledge of the dangerous floor condition and also claimed they bared no responsibility for the trip and fall incident.  The case against Starbucks alleges that a Pasadena city health inspector cited the dangerous condition during an inspection and a contractor for Starbucks also warned the restaurant seven months earlier that the flooring needed to be replaced.

Before the settlement, the presiding judge ruled that there was sufficient evidence to allow a jury to decide if Starbucks acted with a conscious disregard for the safety of its customers.

  Slip and Fall Lawsuit Filed Against Jail

A $100,000 lawsuit has been filed against Jefferson County after a slip and fall incident at the Jefferson County jail.  Noryour Akins (the suit does not clarify whether she was an inmate, county employee or visiting citizen), alleges there were no signs warning that the floor had recently been mopped.

The suit states that "Akins exited the officers' dining room and entered the hallway that had just been mopped by employees of the county or inmates."  The suit goes on to say that "The floor was still wet and there were no signs to warn her of this dangerous condition."

The resulting fall left Akins with injuries to her back, lower extremities, head and right shoulder.  She is now suing for more than $100,000 for alleged medical expenses, impairment, lost wages, and mental anguish.

  Slip and Fall Case Dismissed in New Orleans

In New Orleans, Orleans Parish Civil District Court has dismissed three defendants that were involved in a slip and fall suit.  Karno 327 Bourbon St. Real Estate, 327 Bourbon St. Inc, and karno SP Holdings were being sued by Rene Lopez after Lopez slipped inside of the Temptations Gentleman's Club, which leases a property owned by the defendants.

The lawsuit states that Lopez was a "business invitee" at Temptations when he "encountered defective and dangerous stairs and component parts and fell."  The lawsuit claims that the defendants are liable for damages associated with the fall.

The attorney for the three dismissed defendants argues that the filed motion "makes a blanket assertion that all named defendants failed to maintain the premises" when his clients were merely the owners of the building.  Their attorney also asserts that Temptations and Bourbon Burlesque Club, who are leasing the property, were responsible for maintaining the premises.

The plaintiff withdrew their charges against the defendants before a summary judgment could be set.

A motion for a slip and fall accident lawsuit will be heard for the injury that took place in March 2000. The slip and fall accident involves a woman falling outside of a Harrah's Casino.

Stella Lee is suing due to her fall that was caused by a "hunk of concrete sticking up from the sidewalk." The original lawsuit incorrectly named Louisiana Jazz Co., Harrah's Operating Company Inc., Harrah's New Orleans Management Co., Harrah's Jazz Finance Corp., Harrah's Jazz Finance Co., Harrah's Jazz Co., and Harrah's Jazz Casino as defendants.

Much of the case was not pursued for some time which led to Jazz Casino filing for dismissal which was granted. Now a new trial is being sought.

A Wood County, West Virginia woman is suing a McDonald's due to injuries she sustained after slipping and falling there two years ago.

April Wise reportedly walked into the Putnam County McDonald's when she slipped and fell due to a wet floor. She further reports that there were no warning signs and the non-slip mat was removed from the foyer.
