Motorcycle Accident May Have Involved Alcohol
Posted By Personal Injury Editor

While news stories often feature drunk drivers, they do not highlight another dangerous segment of traffic: drunk motorcycle operators. Although motorcycles are smaller and may appear less dangerous, one man could face serious charges after injuring several pedestrians last week with his motorcycle.

Officers with one sheriff's department were called to the scene of a motorcycle accident in which the driver, a 42-year-old man, ran into a group of people walking on a local street. Of the three - a mother, her son and a teenage female friend - just the 18-year-old girl was seriously injured. Both she and the motorcycle rider were flown to a nearby hospital with serious but non-life-threatening injuries.

Neither the rider nor his passenger, who did not receive any serious injuries, was wearing helmets at the time of the crash.

When someone you love has been badly hurt in a motorcycle accident, you will want to help them as much as possible.  One way to seek help is by hiring a personal injury lawyer who can protect your loved one's legal rights.

Nivea Hamilton Nash Involved in Accident
Posted By Personal Injury Editor

While a drunk driving accident is hardly news anymore, it is when it involves even a minor celebrity like Nivea Hamilton Nash.

The ex-wife of the Dream and mother to one of Lil Wayne's children, the 29-year-old Nash was visibly belligerent when officers arrived on the scene of the accident. It appears as though she was speeding along a road in Atlanta when she lost control of the vehicle, hitting a tree. At the time, she had a baby with her, in the backseat of the Mercedes. Nash was taken into custody and transported to Fulton County Jail, where she continued to give officers a hard time.

She was returning home from a wedding of another woman who gave birth to Lil Wayne's child, Toya Carter. Even though officers reported that Nash had "bloodshot, glassy eyes and smelled like alcohol", family members stated that Nash had not been drinking or driving at speeds over the posted limit after the wedding.

Wrongful Death Lawsuit Settles in Tucson
Posted By Personal Injury Editor

This past Tuesday, an attorney representing a teen that was wrongfully killed while riding his bicycle argued that a restaurant and an impaired driver were at fault for the 14 year old boy’s death. According to the lawyer, if the restaurant had not served the driver 10 beers within a 5 hour period, she would not have killed Jose Rincon Jr.

At first the defendants argued that Rincon’s death was caused by a road defect.  However, his lawyer countered that the driver, Glenda Rumsey, was responsible for the boy’s death and so was the restaurant that continued to serve her alcohol.

The wrongful death trial was held in the Pima County Superior Court. Three attorneys were permitted to give opening statements on behalf of their clients.

Rincon’s death occurred on January 12, 2008. After his death, his parents, Jose Rincon Sr. and Adriana Rincon, filed a wrongful death claim. The parents listed Rumsey and Chuy’s restaurant as defendants on their claim.

Rincon Jr. had been riding his bike on East Broadway at 7:20 PM when Rumsey crashed into him and one of his friends. His friend managed to survive the accident, but Rincon was not so lucky.

After police arrested Rumsey, they had her take a blood-alcohol test two hours after the accident had occurred. In the state of Arizona, the legal blood alcohol limit is 0.08%.  Rumsey’s blood alcohol result was .249%.  Formal charges were brought against Rumsey and she was later convicted of manslaughter and sentenced with 14 years imprisonment.

It is reported that the Rincon family was able to settle their wrongful death claim for an unspecified amount.

Have you lost a beloved family member?  If so, you may want to consider your legal options. An experiencedwrongful death lawyer can assist you!
