So far, there have reportedly been eight reported cases in this matter with four of them involving minor scrapes and cuts. The bicycles have been sold since December 2007 and consumers should stop using them immediately.

These defective bottles are not child-resistant as a result. The actual mouthwash inside is fine, although could be dangerous to a child if they are able to access it without help.

| Taco & Cheeseburger Flavored Pringles Chips Recalled |
| Posted By Personal Injury Editor |
 |
Proctor & Gamble, the parent company of Pringle's chips, has voluntarily recalled the taco and cheeseburger flavored chips. The recall came after the FDA was notified that the hydrolyzed vegetable protein (HVP) used to enhance the flavor of the chips could be contaminated with small amounts of salmonella.
Anyone who has purchased Pringle's Restaurant Cravers Cheeseburger chips or Pringle's Family Faves Taco Night flavored chips are asked to just throw the chips away. If you or someone in your family becomes sick after eating the chips, it's important to see a doctor right away, and then report the sickness to the FDA. So far, no reports of injury or illness have been made, and FDA spokeswoman Rita Chappelle says the chances of suffering from salmonella poisoning is very low.
The HVP was produced by a company called Basic Food Flavors Inc. So far, the FDA has recalled food products from 26 other brands that were made with Basic Food Flavors' HVP. The FDA said it will update and amend that this list as more products are reported.
The contamination was discovered by a customer of Basic Food Flavors during routine testing, who then reported the findings to the FDA.
If you or a loved one has become sick or ill after eating a particular food product, you should consider consulting a personal injury lawyer about your legal options. While you may have nothing more than simple food poisoning or a bad reaction to the food, sometimes illnesses can be contributed to salmonella and other harmful substances. If you can prove a food manufacturer failed to take reasonable measures to ensure its food was safe for public consumption, you could stand to recover compensation for your medical expenses, lost wages, and pain and suffering. |

| Commonly Used Hip Implants May Be Defective |
| Posted By Personal Injury Editor |
 |
The New York Times reports that orthopedic surgeons throughout the country are concerned that “metal on metal” artificial hip replacements may be causing severe tissue and bone damage in some patients. When this damage occurs, replacement surgeries are necessary within one or two years.
According to the article, these types of artificial hips are used in about 1/3 of the 250,000 hip replacements that are performed annually, usually during a traditional hip replacement procedure or in a procedure known as resurfacing.
For a long time these types of hip implants have been considered more durable than other kinds of implants due to the cobalt and chromium used to make the artificial ball-and-socket joints. Artificial hips are supposed to last for approximately 15 years, and should only need to be replaced earlier for something like a dislocation. Although the reason for the problems with the artificial hips still isn’t clear, studies indicate that when the devices wear down quickly, large amounts of metallic debris is absorbed into the patient’s body, which can lead to inflammatory reactions that can vause “pain the groin area, death of tissue in the hip joint, and loss of surrounding bone.” Furthermore, when these devices need to be replaced, some patients may experience lasting complications following surgery.
Orthopedic surgeons are being advised to use these types of hip replacement devices with “great caution, if at all.” It is estimated that 1-3% of people who receive the implants could be affected by the problem, which equates to thousands of patients throughout the country.
At this time, it’s not clear whether one particular brand of the implants is more or less dangerous than any other.
When a defective product causes injury or pain to the consumer, the consumer has the right to take legal action in a product liability lawsuit. If you think you may have grounds to file a lawsuit, it’s best to consult a knowledgeable personal injury attorney as soon as possible. An attorney can evaluate the strength of your claim and give you an idea as to how much you may be able to recover in your lawsuit. |

| Defective Products Lawsuit Filed Against Subaru Following Deadly Accident |
| Posted By Personal Injury Editor |
 |
The family of a California woman who was killed when her Subaru Forester flipped and rolled over multiple times has filed a product liability lawsuit against the automaker.
The family of Lisa Ann Thayer say defects with the vehicle failed to protect their loved one in the accident. Thayer’s family has filed their
wrongful death lawsuit against Subaru of America Inc., Fuji Heavy Industries LTD of Japan, and Autoliv North America.
According to the family’s attorneys, Thayer was wearing her seat belt properly when she lost control of the vehicle. However, during the crash her seat belt broke, causing Thayer to be launched out of the vehicle’s passenger compartment. Thayer was killed in the accident, but fortunately her daughter survived with injuries.
The lawsuit claims that the vehicle’s occupant restraint system was defective, and that it failed to provide Thayer with the protection she needed—a federal requirement. The lawsuit also alleges that the defendants have known since the 1970s that the glass used in the vehicles could be laminated and enforced to help prevent ejection, but has simply failed to do so. On a similar note, the lawsuit also claims the defendants misrepresented vehicle testing data to the federal government regarding the windows’ safety, and that the defendants ignored suggestions from its own engineers to make the window system safer.
The family is seeking an undisclosed amount in damages for pain and suffering, person injuries, wrongful death, medical bills, and economic losses.
If you have suffered an injury in some type of SUV accident or roll over accident, you should take a moment to consult an experienced
personal injury attorney about your legal rights and options in regards to recovering compensation.

| Types of Defective Products Claims |
| Posted By Personal Injury Editor |
 |
When a consumer suffers an injury due to a defect with a particular product, they may have grounds to pursue a product liability lawsuit.
Designers, manufacturers, and retailers have a legal duty to ensure their products are safe for public use. When a defect with the product causes some type of injury or death, the consumer or his/her surviving family members have the right to pursue a product liability lawsuit for compensation or wrongful death benefits. However, in order to win a product liability lawsuit the victim must prove the product was defective in at least one of the following three ways:
-
There was a
design defect with the product, meaning the product was inherently defective due to its design
-
There was a
manufacturing defect, meaning the product became defective because of an error or mistake made during the manufacturing process
-
There was a
marketing defect, meaning the product wasn’t properly labeled, warning labels were left out, or the product was packaged without the right instructions.
If you think you may have a product liability claim, it’s important to consult a
personal injury attorney before taking any sort of legal action. An attorney can answer any questions you may have regarding your legal rights, as well as review your case to determine if you have a valid claim. If you do have grounds to file a claim, an attorney can advocate your rights to recovery and guide through the legal process to help you secure the largest possible settlement.

| Graco Strollers Recalled—Hinge Poses Amputation Risk |
| Posted By Personal Injury Editor |
 |
Nearly 1.5 million strollers have been recalled by the Consumer Product Safety Commission after it received several reports claiming children’s fingertips were cut off.
The strollers have a hinge that can lacerate fingertips when opening and closing the canopy. So far, the company has received five reports in which children lost their fingertips and two reports of children whose fingertips were cut.
Made by Graco Children’s Products, the strollers were sold at a variety of stores, including Wal-Mart, K-Mart, Sears, Target, and Toys-R-Us from October 2004 through December 2009. The models that were recalled include the Passage, Alano, and Spree strollers and travel systems.
This is the second stroller recall in recent months. Back in November the CPSC issued a recall of Maclaren strollers after several children suffered similar injuries caused by faulty hinges. A spokesperson at the CPSC said the commission is planning to thoroughly review all children’s strollers to uncover any additional hinge problems.
If you have purchased one of the recalled stroller models, you should contact Graco about how you can get your stroller repaired. If your child has suffered an injury due to the stroller’s faulty hinge, be sure to report the incident to the CPSC and then find a personal injury lawyer who has experience handling defective product claims.

| Couple in Cincinnati File Lawsuit Against Toyota for Negligence |
| Posted By Personal Injury Editor |
 |
In Cincinnati, a couple has recently filed a personal injury claim against infamous auto manufacturer, Toyota. In their lawsuit, the couple (Hugh and Pamela Cox) allege that Toyota was negligent and accuse the company of fraud because they encountered a safety issue involving their car’s gas pedals. A few months ago, Toyota issued a massive recall after learning that gas pedals in its manufactured vehicles had defects.
The personal injury claim was filed in Hamilton County Common Pleas Court. The defendants are hoping that their claim will reach class-action status as they believe many Ohio residents may have been impacted by defective automobiles that were manufactured by Toyota. The lawyer representing the Cox family thinks that the lawsuit could potentially involve thousands of people throughout the state of Ohio.
Back in October of 2009, Toyota had recalled over 4 million vehicles. The auto manufacturer said that it noticed pedals were catching on floor mats, which led to problems for drivers. Just this past month, Toyota issued a recall for 2.3 million vehicles after learning that gas pedals were sticking whenever drivers tried to accelerate.
While the Coxes report that they were not injured by their defective vehicle, they claim that the pedal problem could have easily led to catastrophic injuries if their vehicle suddenly accelerated.
The Coxes are seeking punitive damages from Toyota Motor Sales USA. Affiliates of Toyota have also requested that the company pay loans and leases for vehicle owners that have defective pedals until the situation is remedied.
At this time, the spokesperson for Toyota said that the company will not issue any comments as the litigation is pending.
Have you suffered from a dangerous or defective product? If so, take a moment to consult an experienced product liability lawyer near you! |
