Commonly Used Hip Implants May Be Defective
Posted By Personal Injury Editor

The New York Times reports that orthopedic surgeons throughout the country are concerned that “metal on metal” artificial hip replacements may be causing severe tissue and bone damage in some patients. When this damage occurs, replacement surgeries are necessary within one or two years.

According to the article, these types of artificial hips are used in about 1/3 of the 250,000 hip replacements that are performed annually, usually during a traditional hip replacement procedure or in a procedure known as resurfacing.

For a long time these types of hip implants have been considered more durable than other kinds of implants due to the cobalt and chromium used to make the artificial ball-and-socket joints. Artificial hips are supposed to last for approximately 15 years, and should only need to be replaced earlier for something like a dislocation. Although the reason for the problems with the artificial hips still isn’t clear, studies indicate that when the devices wear down quickly, large amounts of metallic debris is absorbed into the patient’s body, which can lead to inflammatory reactions that can vause “pain the groin area, death of tissue in the hip joint, and loss of surrounding bone.” Furthermore, when these devices need to be replaced, some patients may experience lasting complications following surgery.

Orthopedic surgeons are being advised to use these types of hip replacement devices with “great caution, if at all.” It is estimated that 1-3% of people who receive the implants could be affected by the problem, which equates to thousands of patients throughout the country.

At this time, it’s not clear whether one particular brand of the implants is more or less dangerous than any other.

When a defective product causes injury or pain to the consumer, the consumer has the right to take legal action in a product liability lawsuit. If you think you may have grounds to file a lawsuit, it’s best to consult a knowledgeable personal injury attorney as soon as possible. An attorney can evaluate the strength of your claim and give you an idea as to how much you may be able to recover in your lawsuit.

Appeals Court Upholds Verdict in Walgreens Wrongful Death Suit
Posted By Personal Injury Editor

A Florida appeals court has upheld a jury decision in a lower court to award $3.3 million in damages to the family of a woman who died from a medication error.

The original lawsuit was filed by the family of Beth Hippely, who died from a cerebral hemorrhage and paralysis after consuming a prescription drug dispensed at a Walgreens pharmacy.

Hippely’s family claims a teenage pharmacy technician gave Hippely a dosage of a blood thinner medication ten times more powerful than she had been prescribed. As a result, Hippely began hemorrhaging in her brain, became paralyzed, and later died from the overdose. She was taking the medication, Warfarin, as part of her breast cancer treatment.

The Hippely’s case first went to trial in 2007 and the jury sided in favor of the family, awarding them $3.3 million. Walgreens later appealed the verdict. Last month, the court of appeals affirmed the lower court’s ruling to award to Hippely's family compensation.

Are You a Victim of a Pharmacy Error?

Pharmacy errors, particularly medication errors, can lead to catastrophic consequences for the victim, as made evident by what happened to Hippely. Pharmacists are expected to perform their job at a certain level and standard of care. When they don’t, and their negligence leads to the injury or death of a patient, they can be held liable in a medical malpractice lawsuit.

Contact a personal injury attorney if you have lost a loved one due to a medication error or pharmacy malpractice. An attorney can evaluate the circumstances surrounding your case and help you pursue a malpractice lawsuit against the pharmacist and pharmacy responsible.

Jogger Killed When Hit By Plane During Emergency Landing
Posted By Personal Injury Editor

A 38-year-old Atlanta man recently lost his life in perhaps one of the freakiest of all freak accidents in some time.

Robert Gary Jones was killed when he was struck by a single-engine plane making an emergency landing. Jones was jogging on the beach in Hilton Head Island in South Carolina when the accident occurred. He was in the area on a business trip.

Officials say that Jones neither heard nor saw that plane landing directly in his path, supposedly because he was wearing headphones and listening to his iPod. While it may seem unbelievable that anyone that close to an aircraft wouldn’t hear it coming, aviation expert Mary Schiavo says it’s entirely possible in this situation that Jones simply didn’t hear the plane coming. Schiavo, a former inspector general for the National Transportation Safety Board, said there was no noise, “so the jogger, with his ear buds in and the plane without an engine, you’re basically a stealth aircraft.”

Ed Allen, coroner for Beaufort County, said the plane had lost one of its propeller and was gliding towards the ground when it hit and instantly killed Jones. Ironically, both the pilot and his only passenger were able to walk away from the crash.

At this time, a spokesperson for the National Traffic Safety Board said a cause for the crash has not been determined, but the pilot claims the small aircraft began leaking oil at about 13,000 feet. The pilot also allegedly told authorities that oil on the windshield was obstructing his view and that a propeller had flown off, which forced him to make an emergency landing.

The plane is now being transported to Virginia, where investigators plan to inspect it. If it is discovered there was a defect with the plane that caused it to spill oil or lose a propeller, Jones’ family would have grounds to file a product liability lawsuit in pursuit of wrongful death benefits.

If you or a loved one has recently suffered an injury and are interested in learning more about filing a product liability claim, you should take a moment to speak with a knowledgeable and experienced personal injury attorney.

Defective Products Lawsuit Filed Against Subaru Following Deadly Accident
Posted By Personal Injury Editor

The family of a California woman who was killed when her Subaru Forester flipped and rolled over multiple times has filed a product liability lawsuit against the automaker.

The family of Lisa Ann Thayer say defects with the vehicle failed to protect their loved one in the accident. Thayer’s family has filed their wrongful death lawsuit against Subaru of America Inc., Fuji Heavy Industries LTD of Japan, and Autoliv North America.

According to the family’s attorneys, Thayer was wearing her seat belt properly when she lost control of the vehicle. However, during the crash her seat belt broke, causing Thayer to be launched out of the vehicle’s passenger compartment. Thayer was killed in the accident, but fortunately her daughter survived with injuries.

The lawsuit claims that the vehicle’s occupant restraint system was defective, and that it failed to provide Thayer with the protection she needed—a federal requirement. The lawsuit also alleges that the defendants have known since the 1970s that the glass used in the vehicles could be laminated and enforced to help prevent ejection, but has simply failed to do so. On a similar note, the lawsuit also claims the defendants misrepresented vehicle testing data to the federal government regarding the windows’ safety, and that the defendants ignored suggestions from its own engineers to make the window system safer.

The family is seeking an undisclosed amount in damages for pain and suffering, person injuries, wrongful death, medical bills, and economic losses.

If you have suffered an injury in some type of SUV accident or roll over accident, you should take a moment to consult an experienced personal injury attorney about your legal rights and options in regards to recovering compensation.

  Distracted Driving Statistics
Posted By Personal Injury Editor

It’s no secret that cell phone usage while driving is dangerous and increases one’s chances of getting involved in an accident. The following statistics and information shows that despite the warnings and laws in place, drivers around the country continue to use handheld devices, primarily cell phones, while driving.

  • At any given moment in 2008, more than 800,000 Americans were texting, making phone calls, or using a handheld cell phone while driving during the daytime.
  • 6,000 Americans were killed and 500,000 people were injured in accidents caused by a distracted driver.
  • Almost 50% of drivers between the ages of 18 and 24 text while driving, and 1/3 of drivers under the age of 21 admit to texting while driving.
  • Talking on a cell phone while driving causes close to 25% of car accidents.
  • 4 out of every five accidents (80%) are attributed to distracted drivers. In comparison to drunk drivers, only 33% of accidents are caused by alcohol impairment.
  • Texting while driving is approximately 6 times more likely to result in an accident than drunk driving.
  • People who text while driving are 23% more likely to be in a car accident than those people whose full attention is on the road.
  • The Insurance Institute for Highway Safety Motorists found that drivers who use cell phones while driving are 4 times more likely to get into a crash serious enough to injure themselves.
  • The Human Factors and Ergonomics Society found that drivers who talk on cell phones are 18% slower to react to brake lights, and take 17% longer to regain speed after braking.
  • 85% of drivers surveyed admitted to making phone calls while driving.
  • According to a study by the Virginia Tech Transportation Institute:
    • Texting while driving is the most dangerous of all cell phone-related tasks.
    • Teen drivers are more likely to get involved in a crash while talking on a cell phone than an adult.
    • A driver who dials a number while driving is 2.8 times more likely to get in an accident than a non-distracted driver, and a driver reaching for a cell phone is 1.4 times more likely to get in an accident.
    • A truck driver texting while driving is 23.3 times more likely to get in an accident than a non-distracted truck driver, and a truck driver who dials while driving is 5.9 times more likely to crash.
    • For every 6 seconds of driving, a driver who texts takes his eyes off the road for 4.6 seconds.
  • The National Safety Council put out a study in January that says 28% of traffic accidents occur when people talk on their cell phones or text while driving.

Both texting while driving and talking on a cell phone while driving are serious forms of negligence. If you have been injured in a car accident caused by a distracted driver, you may have grounds to file a personal injury lawsuit against the driver to recover compensation for your pain and suffering, emotional trauma, medical bills, lost wages, property damage, and more. A personal injury attorney can review the facts of your accident and help you take the appropriate steps to get the claims process started.

  Types of Defective Products Claims
Posted By Personal Injury Editor

When a consumer suffers an injury due to a defect with a particular product, they may have grounds to pursue a product liability lawsuit.

Designers, manufacturers, and retailers have a legal duty to ensure their products are safe for public use. When a defect with the product causes some type of injury or death, the consumer or his/her surviving family members have the right to pursue a product liability lawsuit for compensation or wrongful death benefits. However, in order to win a product liability lawsuit the victim must prove the product was defective in at least one of the following three ways:

  • There was a design defect with the product, meaning the product was inherently defective due to its design
  • There was a manufacturing defect, meaning the product became defective because of an error or mistake made during the manufacturing process
  • There was a marketing defect, meaning the product wasn’t properly labeled, warning labels were left out, or the product was packaged without the right instructions.

If you think you may have a product liability claim, it’s important to consult a personal injury attorney before taking any sort of legal action. An attorney can answer any questions you may have regarding your legal rights, as well as review your case to determine if you have a valid claim. If you do have grounds to file a claim, an attorney can advocate your rights to recovery and guide through the legal process to help you secure the largest possible settlement.

What to Do After an Accident
Posted By Personal Injury Editor

If you’ve recently been injured in an accident you’re likely feeling a little shaken up and unsure of what to do next.  After an accident, it’s very important that you take the following steps, as they can affect the success of your claim, should you choose to pursue one.

  1. Seek medical treatment right away. A doctor can determine the extent your injuries and treat them accordingly. Furthermore, if you plan on filing a lawsuit, you will need to know the extent of your injuries and the toll they will take on your life so you know how much in damages you should seek. The insurance company and the judge will also take your injuries more seriously if they’ve seen that you went to the doctor for help.
  2. Make sure you are completely honest with your doctor. Do not try to downplay your symptoms. Your doctor needs all the information you can provide so he or she can make a correct diagnosis.
  3. After you’ve seen a doctor, then hire an attorney. It is important that you speak with an attorney as soon as possible. The attorney might need to go to the scene of the accident, speak with witnesses, consult accident experts, and collect crucial evidence. The sooner you contact an attorney, the sooner action can be taken to start building a case.
  4. Make sure you document anytime you’ve missed work due to your injuries, as you have the right to recover compensation for lost wages.
  5. Contact your insurance company and tell them you were in an accident, but make sure you don’t imply that you were responsible for the accident. An attorney can help you file a claim with the insurance company and determine if you have any additional benefits.
  6. Do not speak to the other party’s insurance company. Often times they try to trick you into making statements that will damage your case. Insurance adjusters have clever ways of phrasing questions to try and get people to admit they were at least somehow responsible for the accident. If the other party’s insurance company tries to contact you, you can ask your attorney to speak to them on your behalf.
  7. In general, it’s a good idea not to talk to anyone about the accident other than your doctor and your attorney.

For more tips on what steps you should take following an accident, please do not hesitate to consult an experienced personal injury attorney near you. You’ll be glad you did.

Unusual Therapy Leads to Medical Malpractice
Posted By Personal Injury News

A neurologist used a therapy called repetitive transuranic magnetic stimulation to stimulate the human brain through the skull. This technology is non-invasive, but has lead to side effects such as seizures, fainting spells, headaches, toothaches and neckaches. If this technology is used over time then it can lead to a change in the way the human brain functions, as well as altering blood flow and oxygen levels in the brain. All of these causes have lead to a recent medical malpractice suit being resolved in court.

With medical technology advancing, there are many new treatments available, but not necessarily safe. When medical professionals do not operate properly and put your life in danger when they should be helping you, then you will want to pursue a medical malpractice case. Your life may be forever altered after malpractice, so the guilty party should be held responsible for the pain that they have caused you.

Working with a medical malpractice attorney will allow for you to have an expert on your side protecting your right. A medical malpractice lawyer will know how to proceed forward with your case all while keeping your best interest in mind.   The Importance of Wearing a Helmet
Posted By Personal Injury Editor

If you ride motorcycles, it is imperative that you wear a helmet at all times. Helmets have proven to be hugely effective in reducing the risk of brain damage and other head injuries, and have saved hundreds of lives. To shed some light on the value of wearing a helmet while riding a motorcycle, here are some recent statistics from the National Highway Traffic Safety Administration:

  • It is estimated that helmets saved the lives of 1,829 motorcyclists in 2009
  • It is estimated that 832 more lives could have been saved if all motorcyclists wore helmets
  • It estimated that helmets are 37% effective in preventing fatal injuries to riders, and 41% effective in preventing fatal injuries to passengers
  • For every 100 motorcyclists killed while not wearing a helmet, 37 of them could have been save if they had all been wearing helmets

Not only is it important to wear a helmet, it is also important to ensure the helmet fits property and meets federal regulations. If a helmet doesn’t fit properly or is made poorly, it significantly loses its effectiveness, increasing the risk of serious or fatal injury.

Motorcycle safety is crucial for anyone who plans to ride a motorcycle. If you are interested in learning more motorcycle safety tips, contact an experienced motorcycle accident lawyer today!
